Types of Alimony in a New Jersey Divorce

In New Jersey, there are several forms of alimony. These different types are usually awarded under different circumstances. New Jersey divorce courts recognize that not all divorces are the same, and will determine the type and amount of alimony based on the individual divorce case. Here are the different types of alimony in New Jersey.

Temporary Alimony

Also known as pendent lite, temporary alimony is awarded to one spouse to help them during the divorce process. Since divorces can take months or even years to be finalized, it can take a long time for the final alimony decision to be made. In the interim, a judge may order temporary alimony to be paid. One spouse may file an application for temporary alimony assistance to help them pay for living expenses or support children.

Rehabilitative Alimony

The purpose of this type of alimony is to support a spouse after the end of a short marriage. Rehabilitative alimony is intended to help a spouse reenter the workforce and will support them while they attend school or job training. It is most commonly awarded after a marriage that has lasted between 3 and 6 years.

Reimbursement Alimony

Reimbursement alimony is for a spouse who has given up their own career to help the other spouse acquire a professional license, such as a medical degree, law degree, or MBA. New Jersey courts recognize that a spouse may make considerable sacrifices to support their partner’s pursuit of advancement for themselves. Often, these sacrifices can have a dollar amount attached that will be calculated by an attorney or an accountant. This type of alimony allows family courts to financially reimburse a dedicated spouse for what they gave up.

Limited Duration Alimony

This is the most common form of alimony awarded by New Jersey divorce courts. Limited duration alimony supports a spouse for a limited number of years, and can be awarded after any length of marriage. This type of alimony has a start and an end date, and is the preferred alimony for many spouses who are paying alimony. These arrangements are common to support the custodial spouse until the couple’s children have reached adulthood.

It is also possible for the two spouses to pay the entire alimony amount or the remaining amount in one payment. This can allow parties to end their contact with each other more quickly, if they desire. This can help prevent or end hostility between divorced spouses.

Permanent Alimony

While permanent alimony isn’t completely unchangeable, it is intended to be lasting, reliable support for the receiving spouse. This type of alimony is most commonly awarded for longer marriages. Permanent alimony, despite the name, can be terminated for a number of reasons, such as the remarriage of the supported spouse or the death of one of the spouses. The alimony can also be reduced through movements called Lepis motions.
